Default Got tickets??

If anyone (else) gets tickets around San Diego, here is a lawyer that fights to get them dismissed for $100. If she doesn't get it dismissed , no charge - but she does fight for a reduced fine and/or traffic school even if not dismissed. Her info is ...

Law Offices of Sydney C. Kirkland (female)
707 Escondido Avenue, Suite 104

Vista, CA 92084
(760) 726-8400

(don't ask how I know this number)

I wish I could use her, but my class A prevents me from fighting any ticket, and no traffic school.

I think you need to have a lawyer look into that for you or call and have a chat with somebody at the DMV because we all thought the same thing about getting our endorsements which included: the lower blood alcohol limit when we got our hazmat endorsements but it turns out these things only apply when you are engaged in activities that would require that license or endorsement i.e. driving a big rig or transporting hazmat. Therefore we could get loaded up to the same limit as everybody else drive and fight all tickets even the ones we deserve.

Side note: I don't think a state has been successful at relieving you of your constitutional rights for any requirement they've put upon you this includes forcing you to provide evidence of guilt (Blood alcohol tests by force). In your case it would be the right to a trial of some kind. But I'm no lawyer.

How long ago did you get your endorsements? The rules have changed. It used to be if you were cited in your personal vehicle then you could still take traffic school. But as of january 2006 they changed it. It doesn't matter what vehicle you are cited in anymore. BTW I jusy got my A in June 2006, and have all but hazmat. I could be wrong, so I'll look into it..

Spewmonkey...actually, in LA County, Orange County, Ventura County and San Bernardino County...I know that if you have a commercial license you can not go to traffic school no matter what you're driving. A lawyer would be a good idea for a commercial driver, but you can ask any lawyer that deals with commercial drivers and they will tell you the same. Now, R4Ltony, you are definately not prohibited from fighting the ticket...you just don't have the option of traffic school.

Now...part two...there is case law (don't ask me to cite it...I can find it if necessary) that does allow for forced blood tests when needed as evidence of a crime...ie DUI. Almost all counties except LA have a force blood draw program, and I know LA county will use it in the case of felonies. They have been doing it for years, and it has stood up to all challenges. And refusal to provide some type of sample...blood, breath or urine will result in a one year suspension of all driving privelages (whether or not you're found guilty in a court...it's a DMV thing...remember the piece of paper you sign that says you will provide a sample when asked) and possible jail time.

Yup...it sucks...and I personally don't get it...but you are correct. I'm sure Mike (Speed) will chime in here when he gets home.

No traffic school for commercial licenses & .04 in any vehicle. We are second class citizens for sure.
